Stop New York bans on street photography!!

New York City is proposing film permit rules that would require city permits and insurance for photography on public streets.

The proposed rules would specifically require permits for any photography:

* involving an interaction among two or more people at a single site for thirty or more minutes, including all set-up and breakdown time in connection with such activities; or...

* photography... involving an interaction of five or more people at a single site and the use of a single tripod for ten or more minutes, including all set-up and breakdown time...

* an "interaction" shall mean conduct involving a communication between two or more people, whether verbal or otherwise


The language is vague, as you can see, and there is NOT a written exemption for amateurs or other casual photography.

We have all heard about tourists being stopped at the Lincoln Memorial by DC law enforcement for taking vacation snapshots. Tourists, photo clubs, Flickr groups could be stopped in NYC for not having a permit.

You only have until August 3 to respond and/or sign the petition. go here to sign

How would they even enforce this?  Even when they had the subway ban on photography, which they reneged I think, with the population of people here, it's almost impossible. 

We can destroy the planet, use as much energy and water as we want here, but we can't take a picture.  Totally makes sense.  Grrr.

Maybe I'm missing the point, but this will not effect most photographers.  It only effects professional shooters who set up outdoor shoots in the city.  This usually involves light stands, lights, shades, cords, etc.  Therefore, if it's in public, you should have insurance.

I'm against big brother as much as the next guy, but this just appears to be the city covering itself against pointless lawsuits.

Except that it doesn't say stands, lights, shades, cords....

It says 2 people.  With a camera.  in the same place.  for more than 30 minutes. 

And honestly?  That's just about everybody.

Yeah, but the language was kept vague so that the police could use discretion in enforcing.  We all know how that can be abused in certain situations...

They also wanted to keep the rules vague so that professional photographers had fewer ways of getting around them. 

I guess we'll all have to dress up as tourists.

That is a good point, it needs to be more specific.
I shoot trains every now and then, you want to talk about vague rules!!
Local police, railroad police, FBI, they all get involved when it come to some train nerds standing next to a rail line shooting trains!!

Actuall, I believe New York already has a post-911 law about photographing trains.  Basically, it's illegal!

And don't they realize how much tourist money they could lose? Why go to one of the most imfamously photographed cities in the world if you can't take a photograph of the streets?

Well, that settles it. I'm not going to New York. I won't go anywhere that I can't freely use my camera for as long as I want where I want. Big Brother has a name and it's NYC Politicians.

benedict, that story makes me so mad! AGHH! Good thing you got most of your pictures back! Just curious, what kind of camera did you have? I'm wondering if you had a P&S digital they would be more likely to interrogate than if you looked like a professional with an SLR?

"discretion when enforcing" is a really scary thing, because to you and me that might mean common sense, but to someone else it's a good way to pick on someone because you feel like it or you don't like that they use a Nikon or a Canon or what they are shooting (like a public landmark) or their hair (like dreads or a hawk) or whatever...

mezzoforno: I was using a Canon SD630 so yes a small point and shoot, also I had been traveling for a a few months and my beard was pretty unkept by then. I was resting the camera against a wall to try and keep it still, so I suppose I probably did look quite shifty! :S
